Welcome to Fuel Fundraising. These Terms of Service (“Terms”) govern your access to and use of the Fuel Fundraising website, mobile application, fundraising platform, and related services. In these Terms, “Fuel Fundraising,” “we,” “us,” and “our” all refer to Fuel Fundraising, Inc., and these words are used interchangeably.
By accessing the platform, creating a campaign, participating in a campaign, making a donation, or otherwise using Fuel Fundraising, you agree to these Terms. If you are creating or managing a campaign for an organization, team, school, club, booster program, or similar group, you confirm that you are using the platform for that organization or program and that the information you provide is accurate to the best of your knowledge.
1. Our Role
Fuel Fundraising provides a technology platform with tools to help organizations create, manage, promote, and receive proceeds from fundraising campaigns.
Each organization is responsible for its campaign, including its purpose, messaging, participants, donor relationships, and use of funds.
Fuel Fundraising does not guarantee that any campaign is tax-deductible unless the organization clearly states so and it complies with applicable law. Donors should consult their own tax advisor if needed.
Nothing in these Terms creates a partnership, agency, joint venture, or similar relationship, and Fuel Fundraising is not a nonprofit organization, trustee, fiduciary, financial institution, or financial advisor.
2. Organization Responsibilities
Organizations using the platform are responsible for ensuring their fundraising activities are appropriate and lawful. This includes responsibility for:
- Campaign information and accuracy
- Communications sent to supporters
- Compliance with applicable laws and school or organizational policies
- Use of funds raised
- Obtaining any required approvals or permissions
- Ensuring appropriate authorization or consent for participant involvement, including where minors participate in fundraising activities
- Any applicable tax reporting or obligations related to funds raised
Fuel Fundraising may request additional information when needed to support or continue a campaign. Organizations are responsible for complying with applicable laws and regulations.
3. Accounts & Campaign Setup
You must be at least 18 years old to create an account. A participant under 18 may use the platform only with the authorization and supervision of a parent, legal guardian, school, coach, or organization, and that adult or organization is responsible for the participant’s use of the platform.
When creating an account or campaign, you agree to provide accurate and current information.
You are responsible for maintaining the security of your account and for activity that occurs under your account.
Fuel Fundraising may temporarily limit or suspend access if information appears incomplete, inaccurate, or inconsistent with these Terms.
Fuel Fundraising may request additional information, documentation, or verification at any time to support account setup, campaign approval, compliance, or payout processing.
4. Payments, Fees & Payouts
Fuel Fundraising uses third-party payment processors and financial service providers to facilitate donations and process payments. Donations are processed into the organization’s own connected payment account, and Fuel Fundraising does not take custody of or hold donor funds. Fuel Fundraising receives its platform fee through the payment processor’s application fee functionality. All payment processing is subject to the terms, conditions, and approval of third-party payment providers.
Platform fees and applicable payment processing fees will be shown to you before you complete a payment, stated as a dollar amount or a percentage of the donation. If a donor is offered the option to cover certain processing costs, that option will be presented as a clear choice that is not selected by default, and the donor may decline it. The total amount to be charged will be displayed before the donor confirms the donation.
Fundraising proceeds, less applicable fees, refunds, chargebacks, payment reversals, reserves, holds, or other adjustments, are paid to the organization from its connected payment account using the selected payout method. Payout timing and reserve or hold decisions are controlled by the payment processor.
Payout timing is an estimate and may vary based on banking procedures, payment processor timelines, weekends, holidays, account verification, compliance checks, or routine processing reviews.
To protect the platform, organizations, and donors, Fuel Fundraising reserves the right, in its reasonable discretion, to delay, withhold, place holds on, offset, or adjust payouts when necessary to:
- Address refunds, chargebacks, or payment disputes
- Verify account, identity, or payout information
- Comply with payment processor, banking, or legal requirements
- Investigate suspected fraud, misuse, or policy violations
- Resolve errors, discrepancies, or unusual transaction activity
- Maintain reasonable reserves or temporary holds where necessary to manage risk or ensure proper processing
5. Refunds & Payment Issues
Donations may occasionally be subject to refunds, chargebacks, or payment disputes.
To request a refund, a donor may contact Fuel Fundraising at the email address in the Contact section or contact the organization identified at checkout. Nothing in these Terms limits a donor’s right to dispute a charge with their card issuer or bank.
Fuel Fundraising may review and process these situations in accordance with payment provider requirements and applicable law.
Organizations are responsible for refunds or payment issues connected to their campaigns, and related amounts may be reflected in payout adjustments where appropriate.
6. Donor Communications
The communication tools, permissions, and messaging rules that apply to donor and supporter outreach are described in the Communications & Messaging section below.
7. Communications & Messaging
Fuel Fundraising may provide communication tools that allow organizations and participants to send fundraising-related communications through email, text message, push notification, social sharing, or similar methods.
Organizations and users are responsible for ensuring they have appropriate permission to provide contact information and communicate with supporters.
Users may not use the platform to send misleading, unlawful, harassing, unauthorized, or spam communications.
By using the platform, users acknowledge that Fuel Fundraising and its service providers may send operational, campaign-related, account-related, fundraising-related, or support communications. Message frequency may vary. Message and data rates may apply.
Recipients may opt out of text messages by replying STOP and may request help by replying HELP. Recipients may opt out of other communications by following the instructions provided in the message.
Fuel Fundraising reserves the right to limit, suspend, or restrict messaging features or campaigns when necessary to protect users, donors, organizations, carriers, service providers, or compliance obligations.
8. Acceptable Use
To keep the platform safe and effective for everyone, users may not use Fuel Fundraising for:
- Misleading or dishonest fundraising
- Illegal activities
- Harassment or harmful conduct
- Misuse of personal or donor information
- Activities that violate school or organizational policies
- Attempts to interfere with platform functionality or payment systems
Fuel Fundraising may, in its sole discretion, remove content, refuse or restrict campaigns or accounts, or limit access to the platform when necessary to protect users, donors, organizations, the platform, or compliance obligations.
9. Donor Terms
Donors are encouraged to review campaign information before contributing.
Donations are made to support the organization identified at checkout. Fuel Fundraising does not control or supervise how organizations ultimately use funds.
Fuel Fundraising does not guarantee donation volume, fundraising performance, or campaign success.
10. Privacy
Your use of the platform is also governed by the Fuel Fundraising Privacy Policy, which explains how information is collected, used, and protected.
Organizations are responsible for handling supporter and participant information responsibly and in accordance with applicable privacy expectations.
If you are a California resident, you may have the right to know what personal information is collected about you, to request that it be deleted, and to opt out of the sale or sharing of your personal information. You will not be denied service or charged a different price for exercising these rights. The Privacy Policy explains how to make a request.
11. Third-Party Services
Fuel Fundraising works with trusted third-party providers, including payment processors, hosting providers, and communication tools.
Fuel Fundraising is not responsible for delays, outages, or issues caused by third-party services.
Use of certain services may also be subject to additional third-party terms, policies, or requirements.
12. Intellectual Property
Fuel Fundraising owns the platform, including its technology, design, branding, and content.
Organizations retain ownership of their own names, logos, and uploaded campaign materials. By using the platform, you allow Fuel Fundraising to display and use your content as needed to operate and promote your campaign.
13. Platform Availability
We strive to provide a reliable platform, but availability may occasionally be affected by maintenance, updates, or external factors.
We do not guarantee uninterrupted access at all times.
Fuel Fundraising may modify, update, or discontinue features of the platform at any time.
14. Disclaimers
The platform is provided “as is” and “as available.”
To the fullest extent permitted by law, Fuel Fundraising disclaims all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Fuel Fundraising does not guarantee specific fundraising results, uninterrupted service, or error-free operation.
15. Limitation of Liability
To the fullest extent permitted by law, Fuel Fundraising and its officers, directors, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of donations, loss of data, delays, service interruptions, or third-party failures.
To the fullest extent permitted by law, Fuel Fundraising’s total liability for any claim related to the platform or these Terms will not exceed the total platform fees paid to Fuel Fundraising in connection with the specific campaign giving rise to the claim.
16. Responsibility for Campaigns
Organizations are responsible for their campaigns, communications, and use of funds.
Organizations agree to be responsible for any claims, losses, or expenses arising from:
- Their fundraising activities
- Campaign communications or representations
- Use of funds raised
- Information or content provided through the platform
- Violations of these Terms or applicable laws
To the extent permitted by law, organizations also agree to indemnify, defend, and hold harmless Fuel Fundraising from third-party claims, losses, and expenses, including reasonable attorneys’ fees, that arise from their campaigns or use of the platform. Fuel Fundraising will give the organization prompt notice of any such claim and reasonably cooperate in the defense.
Fuel Fundraising will work in good faith with organizations to resolve issues while taking reasonable steps to protect the platform and its users.
17. Suspension or Termination
Fuel Fundraising may limit or suspend access to the platform if necessary to address misuse, inaccurate information, or risks to users, donors, or the platform. Where practical, Fuel Fundraising will give you notice and a chance to correct the issue before suspending access, unless doing so would create a legal or safety risk.
A suspension or termination does not change who owns the fundraising proceeds. Funds already collected for an organization remain payable to that organization, subject to refunds, chargebacks, and payment processor requirements.
You may stop using the platform at any time, and you may request a copy of the campaign information you provided before your account is closed.
18. Electronic Acceptance
These Terms may be accepted electronically, including by checking a box, creating a campaign, or continuing to use the platform.
You agree to receive communications electronically and that electronic acceptance is valid and binding.
19. Unforeseen Events
Fuel Fundraising is not responsible for delays or interruptions caused by events beyond our control, such as internet outages, payment processor issues, natural events, or other unexpected circumstances.
20. Changes to These Terms
Fuel Fundraising may update these Terms from time to time. For material changes, Fuel Fundraising will provide notice through the platform or by email before the changes take effect, at least 14 days in advance. Continued use of the platform after an update takes effect means you accept the updated Terms.
21. Dispute Resolution
We hope to resolve concerns informally whenever possible. If you have a concern regarding the platform or these Terms, please contact Fuel Fundraising first so we can attempt to address the issue directly.
To the fullest extent permitted by law, disputes arising from or relating to the platform or these Terms will be resolved through binding arbitration on an individual basis and not through court proceedings, except for matters that may be brought in small claims court. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect.
You may opt out of this arbitration agreement by sending written notice to Fuel Fundraising within thirty (30) days after you first accept these Terms. If you opt out, neither you nor Fuel Fundraising will be required to arbitrate, and the opt-out will not affect any other part of these Terms.
You agree that claims will be brought only in an individual capacity and not as part of a class action, consolidated action, or representative proceeding.
Nothing in this section limits either party’s ability to seek temporary injunctive or equitable relief as permitted by law.
22. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the dispute resolution section above, any matter not subject to arbitration will be brought in the state or federal courts located in California, and you consent to the jurisdiction of those courts.
23. General Terms
If any part of these Terms is found to be unenforceable, the remaining sections will continue to apply.
These Terms, together with the Privacy Policy, the Organization Agreement, and the Donation Terms & Disclosures, represent the full agreement between you and Fuel Fundraising for use of the platform.
